Terms of Service

1. Acceptance of Terms

By accessing or using the Exorous platform ("Service"), operated by Exorous Technologies, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Exorous Technologies provides AI-powered ad intelligence tools, including competitor ad scanning, AI analysis, and creative variation generation for e-commerce businesses.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Organizations may have multiple members with different roles and permissions.

4. Subscription and Billing

Paid plans are billed monthly via Paddle. You may cancel at any time; access continues until the end of your current billing period. Credits expire at the end of each billing cycle and do not roll over.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Scrape or redistribute competitor ad data outside the platform
  • Attempt to reverse-engineer the AI analysis models
  • Share account credentials with unauthorized parties
  • Exceed rate limits or abuse the API

6. Intellectual Property

Generated ad variations are owned by you. Competitor ad data sourced through the platform is subject to the terms of our data providers. The Exorous platform, including its AI models and algorithms, remains the intellectual property of Exorous Technologies.

7. Data Retention

Raw ad scan data is automatically deleted after 3 days. AI analyses and generated variations are retained as long as your account is active. You may request full data export or deletion at any time via our Data Deletion page.

8. Agency Operator Responsibility

The agency is the operator of record for any ad account action proposed by Exorous and approved by the agency's authorized user. The agency accepts full responsibility for such actions. Exorous Technologies provides tooling only and does not act as fiduciary, advertiser, or agent of record.

9. Benchmark Data Contribution

By default, anonymized aggregate performance metrics from connected ad accounts contribute to industry benchmarks. Agencies may opt out in Settings ’ Privacy.

10. Limitation of Liability

The Service is provided "as is." Exorous Technologies is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount paid in the preceding 12 months.

11. Agency Responsibility & Indemnification

The agency is the operator of record for all ad accounts connected through Exorous. The agency accepts responsibility for any agent-proposed actions they approve and execute. Exorous is a tooling provider, not a fiduciary, and is not liable for ad spend outcomes, account suspensions, or platform policy decisions resulting from approved actions. The agency agrees to indemnify and hold Exorous Technologies harmless from claims arising out of approved agent actions, ad creative content, or use of connected ad accounts.

12. Changes to Terms

Exorous Technologies may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
